Datoire Foundation Participation Agreement & Release of Liability

THIS IS AN AGREEMENT AND RELEASE OF LIABILITY. READ BEFORE PARTICIPATING.

Waiver and Indemnification Form

I hereby waive all claims for injury or loss to person or property during participation in classes, workshops, or other activities. My participation in these activities is voluntary and at my own risk. To the best of my knowledge, the health information I have provided is accurate. I acknowledge and fully understand that I will be engaging in activities that involve the risk of injury, including but not limited to, muscle strains, pulls or tears of muscles, ligaments, or tendons, and wrist or foot injuries.

I certify that I am in good health and do not suffer from any heart condition or other ailment that could be exacerbated by the exertion involved in the activities in which I may participate. I agree to comply with all instructions given by the instructor or their assigns. I hereby release the respective owners, directors, instructors, and assigns from any liability claims, demands, injuries, actions, or causes of actions to my person or property arising out of or connected with the use of any of the services, equipment, or facilities provided.

I also agree to indemnify the said owners, directors, instructors, agents, and assigns for any claims advanced by me or on my behalf, or as a result of any injury to me whatsoever. Furthermore, I confirm that I either have specific insurance to cover any injuries that I may sustain or that I have chosen to participate in these activities without insurance coverage and agree to assume full responsibility for any and all risks, known and unknown, bodily injury, death, and property damage which may arise from my decision to participate in the accepted activities.

 

By booking services, offerings, events, or any activities at Datoire Foundation, I agree that I have been informed that I should not participate in any activity if I have any doubt or if I am uncertain as to my current medical condition. I hereby certify that I am at least 18 years of age. If I am not at least 18 years of age, my parent(s) and/or legal guardian(s) provide consent by booking services on my behalf.  I have carefully read and fully understand the foregoing provisions and freely enter into the Waiver and Indemnification Form agreement.

Photography & Videography Release

I hereby grant Datoire Foundation, its owners, directors, instructors, agents, and assigns the right to take and use photographs and/or videos of me in connection with my participation in their activities. I authorize Datoire Foundation to use and publish these photographs or videos in print and/or electronically.

I agree that Datoire Foundation may use such photographs or videos of me with or without my name and for any lawful purpose, including but not limited to publicity, advertising, and web content.

I understand and agree that all ownership (including copyright), as well as other rights, title, and interest in these photographs and videos, shall belong exclusively to Datoire Foundation. I waive any right to inspect or approve the finished product wherein my likeness appears or to receive any compensation for their use.

 

By booking services, offerings, events, or any activities at Datoire Foundation, I confirm that I have carefully read and fully understand the Photography and Videography Release and freely agree to its terms. I hereby certify that I am at least 18 years of age. If I am not at least 18 years of age, my parent(s) and/or legal guardian(s) provide consent by booking services on my behalf.

 

Communication Consent

By participating in the activities offered by Datoire Foundation, I consent to receiving electronic communications from the organization. This includes, but is not limited to, emails, text messages, and social media messages regarding class schedules, workshop details, event information, and other updates relevant to my participation. I understand that I can withdraw my consent to receive such communications at any time by notifying Datoire Foundation in writing.

By booking services, offerings, events, or any activities at Datoire Foundation, I confirm that I have carefully read and fully understand the Communication Consent and freely agree to its terms. I hereby certify that I am at least 18 years of age. If I am not at least 18 years of age, my parent(s) and/or legal guardian(s) provide consent by booking services on my behalf.

COVID-19 Clause

I acknowledge the risks associated with COVID-19 and voluntarily assume all such risks related to my participation in Datoire Foundation activities. I agree to adhere to all health and safety guidelines issued by Datoire Foundation, including but not limited to wearing masks, practicing social distancing, and following sanitation protocols.

I confirm that, to the best of my knowledge, I am not currently infected with COVID-19 and will not participate if I exhibit any symptoms. I release Datoire Foundation, its representatives, and employees from any liability related to COVID-19 that may arise from participation.

By booking services, offerings, events, or any activities at Datoire Foundation, I confirm that I have carefully read and fully understand the COVID-19 Clause and freely agree to its terms. I hereby certify that I am at least 18 years of age. If I am not at least 18 years of age, my parent(s) and/or legal guardian(s) provide consent by booking services on my behalf.
